Abstract:The lack of legal system, organization system, and poor executive capacity, cause that the patent executive functions of intellectual property administrative system cannot meet the requirements of IP protection, and also are difficult to adapt to the innovationdriven development strategies implemented in new situation. At the national and local IP Offices, ambiguity in administrative management, enforcement, and public service, has become a serious bottleneck in the healthy development of the China's IP administrative system. In the context of building national IPR powerhouse, IP offices need to play a stronger and more important role in administrative protection and market regulation to curb the power of bureaucrats, reform the patent executive system to better define the relationship between administration and market, effectively improve the patent administration and law enforcement performance.
