中文摘要: 2016年5月,党中央、国务院发布的《创新驱动发展战略纲要》要求提高知识产权的运用能力,而提高知识产权商用能力是提升知识产权运用能力的重点。在区分了知识产权国用、学用和商用的基础上,文章对知识产权商用进行了界定,并分析了其特征,认为知识产权商用是实现创新驱动发展的重要途径和关键议题。文章将知识产权商用划分为内部实施、外部流通、知识产权金融、法律诉讼等几种主要形式,研究了知识产权商用在创造质量、商品形态、专业服务、促进政策、司法保护等方面存在的问题,对美国、日本、韩国等知识产权商用最为成熟和快速发展国家的经验进行了挖掘与分析。最后,提出了强化知识产权商用的政策建议,希望能够有助于推动我国知识产权商用化发展,进而推动知识产权强国建设和创新驱动发展战略实施。
Abstract:The "strategic framework for innovation-driven development", which was released by the CPC Central Committee and the State Council in May 2016, issued to improve the ability to use intellectual property (IP). Improving the ability of IP commercialization is the focus of enhancing the ability to use the IP. On the basis of distinguishing state compulsory use of IP, academic use of IP, and IP commercialization, this paper defines IP commercialization and analyzes its characteristics. This paper holds the opinion that IP commercialization is an important way and the key issue of achieving innovation-driven development. The article divides IP commercialization into four types, which are internal implementation, external liquidity, guarantee financing, and legal proceedings. The paper studies the problem of IP commercialization in five aspects, which are IP quality, product form, professional service, promotion policy, and judicial protection. The article analyzes the main practices and mature experience of United States, Japan, and Korea. Finally, the article proposes policy recommendations to strengthen IP commercialization.
